2. WHAT PERSONAL DATA DO WE COLLECT AND WHEN DO WE COLLECT IT?

When ordering a product or service from Blue Bite or registering on our site or platform, as applicable, you may be asked to enter your name, email address, phone number, information regarding the business you represent, or other details to help you with your experience. We may also collect your payment information (e.g., credit card number and related verification information) and billing and shipping addresses when you purchase a product or service.

Our mobile application, Decode, does not require an account and will not ask you for any personal information.

In addition, our site, platform and mobile applications may collect certain information automatically, including, but not limited to, the type of device you use, your device’s unique device ID, the IP address of your device, your operating system, the type of Internet browser you use, and information about the way you use our site, platform and mobile applications. On the other hand, users may oppose the processing of their data, related to their particular situation, ceasing to process the data from that moment Blue Bite, except for compelling legitimate reasons, or the exercise or defense of possible claims.

If you have given your consent for a specific purpose, you have the right to withdraw your consent at any time, without affecting the lawfulness of the processing based on your consent prior to its withdrawal.

It is also the User's responsibility to keep his/her contact details updated at all times and/or to notify our data protection department by e-mail: privacy@markem-imaje.com, indicating in the subject line of the e-mail: "Update Personal Data Customer Profile", especially in the profiles created for customers of our products, in order to provide a quality service.

We may share your personal data with other companies within the Dover Group, for the provision of certain services, as necessary, and as previously communicated and justified (i.e. affiliated companies and operating companies) (collectively, "Blue Bite Affiliates") to carry out the purposes set out in section 3 above.

We may share your personal data with third-party service providers (including contractors who provide services to us) to assist us with any of the uses of personal data described above.

We may also disclose your personal data to third parties if the disclosure is necessary to comply with applicable laws or regulations; to comply with legal processes or court orders; to respond to requests from public and governmental authorities, or if the disclosure is necessary to enforce our Privacy Policy and/or Terms of Use; to protect your safety; to protect our rights, safety and security of our site and property or that of Blue Bite Affiliates or third parties; to allow us to exercise available remedies or limit the damages that we may sustain.

We may share or transfer your personal data to a third party if Blue Bite enters into, or is involved in, a business transaction such as a merger, acquisition, reorganization or sale of some or all of its assets.

In all of the above cases, Blue Bite has put in place IT and contractual safeguards for the transfer of personal data both within the EU, Switzerland, UK and California and outside those locations with the prior signing of intra-group contracts as well as with third parties in accordance with the new Standard Contractual Clauses for the Transfer of Personal Data, Standard Contractual Clauses (SCC) (europa.eu).

In case of transfer of data at any level, the User will be informed in advance at the time of giving consent.

6. LEGAL BASES

Under EU law, we are required to identify the lawful basis on which we use your personal data. These are:

In accordance with the services we currently provide, we do not collect any sensitive personal data (which under EU law includes, for example, personal data on ethnicity, racial origin, sexuality, political affiliation, biometrics and/or health) through the Blue Bite website.

We reiterate that you may at any time exercise your rights set out in section 4.

7. SECURITY AND CONFIDENTIALITY

We are committed to ensuring the security of your personal data. In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the personal data we collect online. However, we cannot guarantee the confidentiality of non-confidential data such as opinions, questions, comments or ideas that you voluntarily provide to us (for example, through the "Contact Us" tab or similar functions on the Blue Bite website).

We reserve the right to use and disclose such non-confidential information as we deem appropriate in compliance with applicable law, provided that it does not involve the processing of identifiable User data.

The Blue Bite website may contain links to enable you to visit other websites of interest to you easily. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any personal data that you provide whilst visiting such sites and such sites are not governed by this Privacy Policy. You should exercise caution and look at the privacy statement applicable to the website in question.

 11. UNDER 18 YEARS OF AGE

Blue Bite is committed to and has entered into agreements with Supervisory Authorities to protect children from potential attacks on the processing of personal data, and therefore, although local regulations in each country in Europe may vary regarding the age of consent for minors, Blue Bite does not collect or permit (to the best of our knowledge) the collection of personal data from persons under the age of 18. 16. CALIFORNIA PRIVACY RIGHTS

This section provides additional details about California consumers and their rights under the California Consumer Privacy Act ("CCPA"). California Consumer Privacy Act (CCPA) | State of California - Department of Justice - Office of the Attorney General

Under the CCPA, "Personal Information" is defined as anything that identifies, relates to, describes, or is capable of being associated or could reasonably be linked, directly or indirectly, with a particular California consumer. For more details about the Personal Information we have collected in the past 12 months, including the source categories, please see Sections 1 and 2 above. We collect this information for the business and marketing purposes described in Section 3 above. We share this information with the categories of third parties described in Section 6 above. Blue Bite does not sell (as that term is defined in the CCPA) the personal information we collect (and will not sell it without providing an opt-out right). Please note that we may use third-party cookies for our advertising purposes, as described in more detail in Section 5 above. 

The CCPA requires express consent for the use of information for children under the age of 16 and verified parental consent for children under the age of 13. We do not knowingly collect or process information from minors.

Subject to certain limitations, the CCPA provides California consumers with the right to request, free of charge, to learn more about the specific categories or pieces of personal information we collect (including how we use and disclose this information), to delete their personal information, to opt out of "sales" that may be taking place, and to not be discriminated against for exercising these rights.

In November 2020, California voters approved Proposition 24, the CPRA, which amended the CCPA and added new additional privacy protections that began on January 1, 2023. As of January 1, 2023, consumers have new rights in addition to those above, such as:

The right to limit the use and disclosure of sensitive personal information collected about them.
